Current State Of Laws On Cannabis Seeds In Canada

I started doing some research on this subject due to the fact that are offering a Cannabis seed "gifting" section on these forums. The further I went down the rabbit hole the more I realized just what a sorry state the laws regarding Cannabis seeds are in.

If anybody has anything to add to the information here or sees something out of date or incorrect please let me know.

There is a lot of confusion since legalization of Cannabis in Canada about how and where to legally obtain seeds, and just what is illegal. I will break it down here to be as short and sweet as possible.

- Seeds can be legally obtained from a licensed producer. At this time there are only a couple of legal places to buy and they have only one to two strains, such as Argyle in the Ontario Cannabis store.

- Cannabis seeds can be legally obtained from a person that holds a valid medical Marijuana license. These can only be gifted, not sold.

- Gifting in provinces where home cultivation is legal is not illegal. This can be for seeds or clones.

One of the kickers here is that plants you grow must come from legal seeds. I think this would put the vast majority of people growing at home under the assumption that they are legal when in fact are not. Though I am not sure how this rule could ever be enforced, there are tons of growers with medical licenses in Canada.

So this essentially means 99.99% seedbanks in Canada are operating illegally at this time, the plants grown from seeds obtained from these seedbanks are also illegal.

Right now there are three legally licensed producers that can sell Cannabis seeds.

If you're not careful, this kind of sharing could still involve breaking the law. If you want to give or receive this kind of gift within the boundaries of the Cannabis Act, I recommend following these guidelines:

  • It must be a true gift, not a sale or a trade. In the words of Health Canada spokeswoman Tammy Jarbeau, "Selling would include any circumstance where some form of consideration is given, directly or indirectly, in exchange for cannabis and could include subscription services or bartering, in addition to money transactions."
  • The gift must be between two adult individuals. An organization, including a club or a co-operative, cannot legally distribute cannabis without a licence.
  • Cannabis seeds can only be gifted up to 30 seeds at a time. That's because the Cannabis Act treats one seed as the legal equivalent of one gram of dried cannabis, and you can't possess more than 30 grams of weed in public.
  • You can only share up to four cannabis plants at one time.
  • Cannabis plants cannot be shared if they're budding or flowering. The Cannabis Act made it illegal for an individual to distribute budding or flowering plants. It's also illegal to possess any number of budding or flowering cannabis plants in public without authorization.
Consult the appropriate provincial or territorial laws regarding the possession and cultivation of cannabis plants. Provincial law in Manitoba and Quebec prohibits non-medical home cultivation of cannabis.
